Servicevilkår
General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to the use of our online store and to all orders and purchase contracts concluded between consumers and us through our online store.
Our online store is primarily intended for consumers in Germany and the European Union.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activities.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the course of their commercial or self-employed professional activities.
Any terms and conditions of the customer that deviate from these GTC shall not become part of the contract unless we expressly agree to their validity in writing.
Mandatory statutory consumer rights remain unaffected by these GTC.
2. Provider and Contact Information
The online store is operated by:
DENCKER A/S
Færøvej 2
7900 Nykøbing M
Denmark
Email: zabriskiedebroah@gmail.com
Where legally required, additional company and registration information will be provided in the legal notice (Imprint) of our online store.
3. Services Provided by the Online Store
Through our online store, we provide consumers with services including:
-
Presentation and sale of products;
-
Provision of product information;
-
Receipt and processing of orders;
-
Payment processing;
-
Order administration and management;
-
Shipping and delivery of ordered products;
-
Customer support;
-
Processing of returns and refunds;
-
Processing of exchanges and statutory warranty claims where applicable.
We reserve the right to temporarily modify, restrict, or discontinue individual functions of the online store where this is necessary for technical, security-related, operational, or legal reasons.
Statutory consumer rights remain unaffected.
4. Use of the Online Store and Customer Accounts
Certain functions of our online store may require the creation of a customer account.
Customers are required to provide complete, accurate, and up-to-date information when registering and placing orders.
In particular, customers are responsible for:
-
Keeping their login credentials confidential;
-
Protecting their account from unauthorized access by third parties;
-
Updating their information promptly when changes occur;
-
Informing us if unauthorized access is suspected;
-
Not using a false identity or impersonating another person.
Customers may not transfer, sell, or permanently provide their customer account to third parties without our prior consent.
If we have reasonable grounds to suspect misuse, fraud, unlawful use, or a serious violation of these GTC, we may temporarily suspend or permanently close access to the customer account to the extent permitted by law.
5. Conclusion of the Contract
The presentation of products in our online store does not generally constitute a legally binding offer to conclude a purchase contract.
Customers may initially place products in their shopping cart without obligation.
By submitting an order, the customer makes a binding offer to conclude a purchase contract for the products contained in the shopping cart.
Before submitting the order, customers can review their information and selected products and make corrections where necessary.
After receiving an order, customers will generally receive an automatic confirmation by email.
This confirmation generally only confirms receipt of the order and does not constitute acceptance of the customer's offer unless it expressly states that the order has been accepted.
The purchase contract is concluded when we expressly accept the order, for example through an order confirmation, or by dispatching the goods where the dispatch clearly constitutes acceptance of the order.
If an ordered product is unavailable, payment cannot be successfully processed, or the order cannot be fulfilled for another legally permissible reason, we will inform the customer accordingly.
Any payments already made will be refunded in such circumstances in accordance with applicable law.
6. Products and Product Information
We make reasonable efforts to ensure that product descriptions, product images, technical specifications, and other information provided in our online store are accurate and up to date.
The actual appearance of colors and product details may vary depending on the customer's device, screen, and display settings.
Technical modifications, model changes, or minor deviations may occur provided that they do not affect the contractual conformity of the product.
If there are obvious errors in product information, prices, availability, or other information on our website, we reserve the right to correct such errors in accordance with applicable law.
Contracts that have already been concluded remain unaffected unless otherwise required by law.
7. Prices and Payment Terms
The prices displayed in the online store at the time the order is placed shall apply.
Any applicable shipping costs will be displayed during the ordering process.
All legally required price information for consumers, including applicable VAT information, will be presented in accordance with statutory requirements.
The total price, including any applicable shipping costs, will be shown to the customer before the order is completed.
Depending on the delivery location and technical availability, various payment methods may be offered, including:
-
Visa;
-
Mastercard;
-
PayPal;
-
Payment upon delivery, where available;
-
Other payment methods displayed at checkout.
Customers are not entitled to the provision of a specific payment method.
Payments may be processed through external payment service providers. Their respective privacy policies and terms of use may apply.
Unless legally required, we do not store complete credit card or bank card details ourselves.
8. Delivery and Shipping
Delivery will be made to the shipping address provided during the ordering process.
The estimated delivery time will be displayed in the online store or during the ordering process.
Actual delivery times may depend on factors including:
-
Order processing time;
-
Delivery address;
-
Product availability;
-
Shipping provider;
-
Weekends and public holidays;
-
Weather and traffic conditions;
-
Customs or import clearance;
-
Events beyond our reasonable control.
Unless expressly agreed otherwise, stated delivery periods are estimated delivery periods.
If there is a significant delivery delay, we will inform the customer appropriately in accordance with our statutory and contractual obligations.
The customer's statutory rights in the event of delayed delivery remain unaffected.
Further details are provided in our Shipping Policy.
9. Retention of Title
The delivered goods remain our property until the purchase price has been paid in full, to the extent that retention of title is legally permissible.
10. Right of Withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts.
Details regarding the right of withdrawal, the withdrawal period, how to exercise the right of withdrawal, and the consequences of withdrawal are set out separately in our:
Withdrawal Instructions / Return and Refund Policy
Statutory withdrawal rights are not restricted by these GTC.
11. Returns, Refunds, and Exchanges
Returns, refunds, and, where applicable, exchanges will be handled in accordance with our Return and Refund Policy and applicable statutory requirements.
Where consumers have statutory rights, including the statutory right of withdrawal or statutory warranty rights, such rights are not restricted by our return or refund conditions.
Where a refund is legally or contractually due, it will generally be issued using the original payment method unless another legally permissible arrangement has been agreed.
12. Statutory Warranty Rights
All goods sold by us are subject to the statutory provisions governing liability for defects.
If goods have a defect at the time the risk passes to the consumer or do not conform to the contractually agreed characteristics, consumers may exercise their statutory rights.
Depending on the applicable legal requirements, these rights may include:
-
Subsequent performance;
-
Repair;
-
Replacement delivery;
-
Reduction of the purchase price;
-
Withdrawal from the contract;
-
Damages;
-
Other statutory claims.
Any manufacturer's warranty or additional voluntary guarantee that may apply exists independently of statutory warranty rights.
Such a warranty does not restrict the consumer's statutory rights.
13. Customer Service

In the event of violations, we may take appropriate measures to the extent permitted by law.
15. Intellectual Property
The content of our online store is protected by copyright, trademark, and other intellectual property rights to the extent provided by law.
This includes, in particular:
-
Trademarks and logos;
-
Product images;
-

-

However, uninterrupted and continuous availability cannot be guaranteed.
Temporary restrictions or interruptions may occur due to factors including:
-

Network problems;
-
Security incidents;

Cyberattacks;
-
Disruptions involving third-party providers;

Technical errors;

Other unforeseen events.
In the event of technical problems, we will make reasonable efforts to restore the functionality of the online store as quickly as practicable.
Statutory consumer rights remain unaffected.
18. Liability
We are liable in accordance with applicable law for damages caused by intentional or grossly negligent conduct.
We are liable in accordance with statutory provisions for damage resulting from injury to life, body, or health.
We are also liable in accordance with applicable law to the extent that mandatory statutory liability provisions, including product liability laws, apply.
In all other respects, statutory liability provisions shall apply.
Nothing in these GTC excludes or limits liability that may not legally be excluded or limited.
The consumer's statutory rights remain unaffected.
19. Force Majeure
If we are prevented from or substantially hindered in fulfilling our contractual obligations due to events beyond our reasonable control, delays or temporary restrictions may occur.
Such events may include:
-
Natural disasters;
-
Extreme weather conditions;
-
War or comparable conflicts;

Government or regulatory measures;

Widespread network or internet outages;

Significant disruptions to transportation systems;

We will make reasonable efforts to inform customers of significant delays and, where possible, take appropriate measures to resume performance.
Mandatory statutory consumer rights remain unaffected.
20. Data Protection
We process customers' personal information in accordance with applicable data protection laws.
Further information about the personal information we collect, the purposes for which we use it, how long we retain it, and the rights of data subjects is provided in our:
Privacy Policy
The Privacy Policy forms part of the information made available to customers before and during their use of our online store.
21. Changes to These GTC
We may amend these GTC where this is necessary due to changes in legislation, technological developments, changes to our business model, or other legitimate operational reasons.
For contracts that have already been concluded, the GTC applicable at the time the contract was concluded will generally continue to apply unless otherwise required by law.
Changes will be published on our website.
Where legally required, customers will be separately informed of material changes.
22. Applicable Law
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent legally permissible.
If the customer is a consumer and has their habitual residence in another European Union Member State, mandatory statutory provisions of that country that protect the consumer shall remain unaffected.
This choice of law does not deprive consumers of any mandatory consumer protection rights to which they are entitled under applicable law.
23. Dispute Resolution
We aim to resolve customer complaints and disputes quickly and amicably.
Customers may first contact our customer service team with any questions or complaints:
Email:
zabriskiedebroah@gmail.com
The consumer's statutory rights to contact competent authorities, courts, or other legally established dispute resolution bodies remain unaffected.
24. Severability
If any provision of these GTC is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected.
The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
